For example, did you know that for same sex spouses, adultery cannot be given as the reason for divorce? Case law defines adultery as sexual intercourse between persons of the opposite sex. So a man can be divorced because of a sexual relationship with another woman, but cannot be divorced because of his sexual relationship with another man. Judges ruled in a five to four vote that same sex couples must in law get the same federal rights as heterosexual couples. In a statement President Barack Obama applauded the decision. The case concerned the constitutionality of a key part of the Defense of Marriage act or DOMA as it's known which denied benefits to same sex married couples. David Boies, a lawyer from the American Foundation for Equal Rights said after the ruling: "It's a wonderful day for America. Because we have now taken this country another important step towards guaranteeing the promise that it is in our Constitution in our declaration of Independence that all people are created equal, that all people have the inalienable right to life, liberty and the pursuit of happiness." A second ruling has also been interpreted as a victory for gay rights. The case centred on a California state law called Proposition 8 which banned gay marriage. The Supreme court ruled supporters of the law do not have standing to appeal a lower court ruling that struck down the law. Austin Nimocks, senior counsel with the Alliance Defending Freedom responded to the decision. "We are disappointed about The Supreme Court decision on standing but we are happy that Proposition 8 does remain the law of the Sate of California." Gay Marriage Green Card Interview 0:19 The overturn of DOMA created the new option for a same-sex spouse to be able to sponsor their same-sex spouse for a green card. It is how local CIS offices are going to be deciding these cases and how much of each spouse’s history will come to light and what is really fair game for questioning is still unknown. Technically, a gay U.S. citizen or permanent resident spouse has the right to now sponsor their spouse for a green card based on gay marriage but this is new territory for CIS officers. There really has not been universal training or sensitivity for these types of cases . . . . 0:57 Typically as part of green card process in marriage cases, CIS will look to the bona fides of the existing marriage and whether it was entered into legally but also look at the couple’s history. But when it comes to gay and lesbian relationships, that can get little tricky. What if either of the spouses were married before but to a heterosexual? How will this affect the green card process for the gay couple? [more in video]. 1:31 Will CIS scrutinize this type of case more because a person is now out as gay? Unfortunately yes in reality. However, this does not mean that you have to show more documentation than someone who is in a heterosexual relationship to prove the bona fides of your current relationship. But know that if there has been a switch between sexual orientations in your past, credibility of your current marriage is at risk. 2:06 In looking into a spouse’s past, CIS could also look at financial records and scrutinize the dates of divorce and remarriage. This becomes even more crucial in explaining what happened and documenting the validity of past relationships as well as current relationship and if there is any appearance of marriage fraud. [See more in video] 2:44 In the green card process, CIS will be concerned about gay couple’s credibility and may consider the prior relationship or the current one to be fraudulent and only entered into for purposes of getting a green card. [More in video. . . ] 3:27 Even for those who have not been married before, proving that the current relationship is real can be difficult, especially if the state where you reside bans gay marriage. Gay couples in the green card process may find it hard to hold the property in both names including bank accounts, health insurance, lease, tax returns if the state does not allow you to do so. Marilyn Stowe, the founder of Stowe Family Law, appeared on Sky News on Saturday 29 March to discuss gay marriage in England and Wales. With the Marriage (Same Sex Couples) Act 2013 coming into force and the first gay marriages taking place on the night of Saturday 29 March 2014, here is Marilyn Stowe's family lawyer's overview of the new legislation. Gay rights groups have pointed out that even if this persists, a gay spouse can still petition for divorce on the basis of their partner's unreasonable behaviour. Technically speaking, however, there is one scenario in which a same sex married couple could divorce because of "adultery". This would be if one spouse entered into a sexual relationship with a member of the opposite sex. In this interview, Marilyn looks at the legal iisues and remedies for same sex married couples across England and Wales.

Anderson Cooper recently interviewed Florida Attorney General Pam Bondi following the Orlando shootings. He confronted her on anti-gay comments and positions she has taken in the past. Ben Mankiewicz (What The Flick), John Iadarola (ThinkTank), and Michael Shure, hosts of The Young Turks, break it down. Tell us what you think in the comment section below. "On Tuesday, CNN’s Anderson Cooper called Bondi out for her hypocrisy, grilling her about the contradiction between her recent statements and her anti-LGBT rhetoric in defending the state’s marriage ban, when she had claimed in an official court brief that recognizing other state’s same-sex marriages would “impose significant public harm” on Florida. Cooper asked, in light of that work, “Do you really think you’re a champion of the gay community?” Bondi responded that her defense of the state constitution “had nothing to do” with not liking gay people. “My lawyer argued a case defending what the Supreme Court allowed the voters to put in our state constitution,” she explained, adding that “those words have never come out of my mouth.” Cooper observed that, had Florida’s marriage inequality amendment not been struck down, “there would be no spouses [and] boyfriends and girlfriends of the dead would not be able to get information and would not be able, probably even to visit in this hospital.” “Isn’t there a sick irony that you, for years, were fighting that very idea?” he asked her.”* Read more here: http://thinkprogress.org/lgbt/2016/06/14/3788479/anderson-cooper-destroys-pam-bondi-florida-lgbt/ Hosts: Ben Mankiewicz, John Iadarola, Michael Shure Cast: Ben Mankiewicz, John Iadarola, Michael Shure *** The Largest Online News Show in the World. GAY ASYLUM in the U.S. -- Immigration Attorney Heather Poole shares tips on procedure and issues unique to proving eligibility for gay asylum status with USCIS and the Immigration Court. If you fear returning to your home country, learn more about LGBT asylum here. ASYLUM FOR GAY IMMIGRANTS 0:18 To be successful on an application for asylum based on being a gay immigrant or LGBT immigrant, you must show that you have suffered past prosecution on account of a particular ground protected by statute or have a well-founded fear of future prosecution on account of race, religion, membership in a particular social group or political opinion. If you have been discriminated against or persecuted because you are gay in your home country, you could potentially fall within the political opinion protected ground and membership in a particular social group if you are associated in that group. 1:00 The applicant for asylum must show that the government is unwilling or unable to protect the applicant in their home country from harm if they return. In many countries where the police are part of the harassment of gays and lesbians, it is not a stretch for the applicants who are not willing to even go to a police to try to get protection but the applicant still has to show that there was no meaningful way to get a protection from the police. . . . .An application for asylum must also be filed within one year of your last entry. The only exception to this rule is if you can show exceptional circumstances that caused the delay in filing before this point (the deadline). Your case if filed with CIS will first go to an asylum office for decision. 2:47 The direct testimony of the gay asylum applicant can be heavily relied on because there may not be proof that the police were uncooperative if it was unsafe for you to go to police in the first place. But if you cannot collaborate your testimony, it may not be enough. Testimony from an applicant by itself is usually not enough in an asylum claim anymore unless you can prove your testimony is both persuasive and credible and available evidence to support the testimony was not reasonably obtainable by you. 3:24 If you are concerned about going back to your home country because you are gay, transgender, lesbian or bisexual immigration even if it is beyond the one year deadline and you have not filed anything with the immigration, you still have option with Immigration and the court to file for the political asylum. There is also different types of removal relief such as withholding of removal and the convention against torture and withholding. There are options for you. Talk to an immigration attorney before doing anything drastic. 3:48 About Immigration Attorney Heather Poole: I am an expert in complex family base immigration cases and have a 98% approval rate for the past 12 years. It’s been over a year since gay marriage was legalized in all 50 states. How many right wing predictions about marriage equality have come true since then? Cenk Uygur and Ana Kasparian, hosts of The Young Turks, break it down. Tell us what you think in the comment section below. “Sunday marked the first anniversary of the Supreme Court’s landmark marriage equality decision, which, if Religious Right activists were to be believed, was to usher in a horrible tyranny that would lead to mass deaths and war. Of course, the Right’s doomsday predictions about what would happen if same-sex marriage became legal nationwide were totally unfounded, and only a tiny contingent of conservativescame to a protest the ruling in Washington, D.C., this weekend. While the conservative movement certainly hasn’t given up on the fight against LGBT rights and is thrilled by Donald Trump’spromise to appoint anti-LGBT judges who would oppose the marriage ruling, many activists have once again shown that they are more interested in stirring up fears about the LGBT community than in the facts. Here are just five of the craziest predictions that conservative politicians and pundits made about Obergefell v. Hodges, all of which are yet to come true.” Read more here: http://www.rightwingwatch.org/content/five-right-wing-predictions-about-marriage-equality-still-havent-come-true Hosts: Cenk Uygur, Ana Kasparian Cast: Cenk Uygur, Ana Kasparian *** The Largest Online News Show in the World. Former Attorney General of India Soli Sorabjee hailed the Supreme Court's decision on homosexuality and said "Supreme Court in its several judgment has recognised right to privacy". The Supreme Court on Tuesday referred to a five-judge bench a curative petition against Section 377 of the Indian Penal Code which criminalises homosexuality. Colombia’s Attorney General has announced that he will challenge Wednesday’s Constitutional Court decision to grant adoption rights to same-sex couples. Colombian courts are gradually expanding homosexual rights, but this is appeal is a step backwards, say activists. “To impede a child from having a family based only on sexual orientation or the gender of a person or a couple represents an unacceptable restriction on the rights of the child, and furthermore, is contrary to the interests of the minor,” said the President of Colombia’s Constitutional Court. teleSUR http://multimedia.telesurtv.net/v/colombia-ag-will-challenge-same-sex-adoption-rights/
