While the Justice Department says this wouldn't necessarily allow businesses to turn people away because of their race, if the Constitution protects such a right to discriminate against gay people, it would also authorize businesses to discriminate based on national origin, sex, religion, disability, gender identity, or any other basis. That means businesses could put up other signs as well: “We Don’t Sell to Women.” “No Muslims.” “No Transgender People.” All in open defiance of the nation’s civil rights laws. The case before the Supreme Court has deceptively simple facts. Dave Mullins and Charlie Craig were planning their wedding reception in Colorado. Along with Charlie’s mom, Dave and Charlie went to the Masterpiece Cakeshop bakery near Denver to order a cake in July 2012. The bakery turned them away, saying it doesn’t make wedding cakes for gay couples because that would violate its religious beliefs and artistic freedom. Under long-standing Colorado law, businesses that are open to the public can’t turn customers away because they are lesbian, gay, or bisexual. That’s just what happened here, so Charlie and Dave sued. The Colorado courts agreed that it was discrimination and ruled that free speech and religious protections don’t give anyone a right to discriminate. It’s easy to dismiss the case as trivial. Dave and Charlie could — and did — get a cake from another bakery. And few people would really want a cake from a bakery that doesn’t actually want to bake it. But consider what a ruling for the bakery could mean here — constitutional protection for discrimination based on freedom of religion or expression. That’s breathtaking in its scope and consequences. It would mean that a florist could refuse to sell flowers for the funeral of an interfaith couple, a dance studio could turn away the children of an interracial couple, an architect could put up a sign saying, “No Jews,” a doctor could turn away transgender people altogether. And each and every law that makes discrimination illegal would be overridden by the constitutional right to discriminate. If any business has a constitutional right to express its views or its religion by refusing to comply with a nondiscrimination law, it could defy other government rules as well. Businesses could refuse to follow food safety rules because they want to express themselves through their refusal. Or a company could flout consumer protection regulations because they are inconsistent with its religious beliefs. This case has never been about the cake. It’s about whether anyone in America can be turned away from a business because of who they are. It’s about whether the Constitution gives businesses the right to discriminate whenever they want to. Everyone in this country should be opposed to such a radical ruling that would undermine America’s core commitment to equality. That President Trump has endorsed a right to discriminate against LGBT people may not be surprising, given his earlier actions to strip transgender youth of protections in schools and to deprive lesbian, gay, and bisexual people of federal civil rights protections altogether. ASYLUM FOR GAY IMMIGRANTS 0:18 To be successful on an application for asylum based on being a gay immigrant or LGBT immigrant, you must show that you have suffered past prosecution on account of a particular ground protected by statute or have a well-founded fear of future prosecution on account of race, religion, membership in a particular social group or political opinion. If you have been discriminated against or persecuted because you are gay in your home country, you could potentially fall within the political opinion protected ground and membership in a particular social group if you are associated in that group. 1:00 The applicant for asylum must show that the government is unwilling or unable to protect the applicant in their home country from harm if they return. In many countries where the police are part of the harassment of gays and lesbians, it is not a stretch for the applicants who are not willing to even go to a police to try to get protection but the applicant still has to show that there was no meaningful way to get a protection from the police. . . . .An application for asylum must also be filed within one year of your last entry. The only exception to this rule is if you can show exceptional circumstances that caused the delay in filing before this point (the deadline). Your case if filed with CIS will first go to an asylum office for decision. 2:47 The direct testimony of the gay asylum applicant can be heavily relied on because there may not be proof that the police were uncooperative if it was unsafe for you to go to police in the first place. But if you cannot collaborate your testimony, it may not be enough. Testimony from an applicant by itself is usually not enough in an asylum claim anymore unless you can prove your testimony is both persuasive and credible and available evidence to support the testimony was not reasonably obtainable by you. 3:24 If you are concerned about going back to your home country because you are gay, transgender, lesbian or bisexual immigration even if it is beyond the one year deadline and you have not filed anything with the immigration, you still have option with Immigration and the court to file for the political asylum. There is also different types of removal relief such as withholding of removal and the convention against torture and withholding. There are options for you. This week, President Donald Trump and Attorney General proved just how bigoted they are. They have filed an amicus brief with the US Supreme Court in the case of the baker who did not want to bake a cake for a gay couple. The baker argues that I am allowed to discriminate against anyone I want to discriminate against because that's American capitalism and American democracy. The Trump administration filed a brief agreeing with that baker saying, "Yes, if you own a business, you can discriminate against anyone if you don't believe in their particular lifestyle, what they look like, what they do for a living. Have at it. You own that business. Go ahead and treat people like they're animals because you own a business." I am absolutely sick and tired of all of the stupid little Republican lies saying that small business owners are somehow gods walking among us. They are not entitled to discriminate against anyone in this country. I don't care if you own that business or if you've sacrificed everything to build up this business. Good for you. You still have to treat human beings like they're human beings regardless of their sexual preference or religion or ethnicity or anything else. That's our job as human beings, because that's what we are first, human beings. It doesn't matter if you own a business or if you're a factory worker or a billionaire. First and foremost, we're humans, and we should treat everyone with respect, the resect that we demand they serve to us. But that's not what the Trump Administration thinks. That's not what Donald Trump thinks. That's not what Jeff Sessions thinks. They think that if you're gay, you better pick and choose what stores you want to go to and hope that they will serve you, because we don't think they should have to. We think that anyone who owns a business is better than you, and they know better, and they can do better. That's why they can discriminate against you. We don't care about the LGBTQ community. We don't care about other ethnicities or other religions. As long as you're a white business owner, the world is your oyster, a white, straight, business owner. I guess I should clarify, because we have to start throwing that in now, too. The bottom line is this. Donald Trump had promised us during the campaign he was going to be so good, so good for the gay community. But as it turns out, he is just as bigoted, if not even more so than George Wu. Bush was, and those were some bad times. We're going backwards as a country when we start allowing companies, businesses, whatever, to start discriminating against people just based on who they are. We're literally going back to the s's and s's. Pretty soon we're going to have to have separate bathrooms for them. Oh, wait, we're already having that argument, too. I hope everybody in this country understands how far back in time we are going here. If we continue to go back any further, we're going to be right back to the point where in some states it was perfectly legal for one human being to own another one. That is where Donald Trump is taking this country, and Attorney General Jeff Sessions is right along for the ride.

It is how local CIS offices are going to be deciding these cases and how much of each spouse’s history will come to light and what is really fair game for questioning is still unknown. Technically, a gay U.S. citizen or permanent resident spouse has the right to now sponsor their spouse for a green card based on gay marriage but this is new territory for CIS officers. There really has not been universal training or sensitivity for these types of cases . . . . 0:57 Typically as part of green card process in marriage cases, CIS will look to the bona fides of the existing marriage and whether it was entered into legally but also look at the couple’s history. But when it comes to gay and lesbian relationships, that can get little tricky. What if either of the spouses were married before but to a heterosexual? How will this affect the green card process for the gay couple? [more in video]. 1:31 Will CIS scrutinize this type of case more because a person is now out as gay? Unfortunately yes in reality. However, this does not mean that you have to show more documentation than someone who is in a heterosexual relationship to prove the bona fides of your current relationship. But know that if there has been a switch between sexual orientations in your past, credibility of your current marriage is at risk. 2:06 In looking into a spouse’s past, CIS could also look at financial records and scrutinize the dates of divorce and remarriage. This becomes even more crucial in explaining what happened and documenting the validity of past relationships as well as current relationship and if there is any appearance of marriage fraud. [See more in video] 2:44 In the green card process, CIS will be concerned about gay couple’s credibility and may consider the prior relationship or the current one to be fraudulent and only entered into for purposes of getting a green card. Gay couples in the green card process may find it hard to hold the property in both names including bank accounts, health insurance, lease, tax returns if the state does not allow you to do so. Charles LiMandri is an attorney, and a native to San Diego California. His trial experience encompasses many areas of civil litigation. He has successfully represented clients in personal injury, business litigation, products liability, medical malpractice, and automotive litigation cases. Additionally, he has successfully handled cases involving insurance coverage, construction, environmental and maritime matters. Since 1983 LiMandri has tried numerous civil trials to verdict in state and federal courts, and he is admitted to practice before the United States Supreme Court.
