The case concerned the constitutionality of a key part of the Defense of Marriage act or DOMA as it's known which denied benefits to same sex married couples. David Boies, a lawyer from the American Foundation for Equal Rights said after the ruling: "It's a wonderful day for America. Because we have now taken this country another important step towards guaranteeing the promise that it is in our Constitution in our declaration of Independence that all people are created equal, that all people have the inalienable right to life, liberty and the pursuit of happiness." A second ruling has also been interpreted as a victory for gay rights. The case centred on a California state law called Proposition 8 which banned gay marriage. The Supreme court ruled supporters of the law do not have standing to appeal a lower court ruling that struck down the law. Austin Nimocks, senior counsel with the Alliance Defending Freedom responded to the decision. "We are disappointed about The Supreme Court decision on standing but we are happy that Proposition 8 does remain the law of the Sate of California." It is how local CIS offices are going to be deciding these cases and how much of each spouse’s history will come to light and what is really fair game for questioning is still unknown. Technically, a gay U.S. citizen or permanent resident spouse has the right to now sponsor their spouse for a green card based on gay marriage but this is new territory for CIS officers. There really has not been universal training or sensitivity for these types of cases . . . . 0:57 Typically as part of green card process in marriage cases, CIS will look to the bona fides of the existing marriage and whether it was entered into legally but also look at the couple’s history. But when it comes to gay and lesbian relationships, that can get little tricky. What if either of the spouses were married before but to a heterosexual? How will this affect the green card process for the gay couple? [more in video]. 1:31 Will CIS scrutinize this type of case more because a person is now out as gay? Unfortunately yes in reality. However, this does not mean that you have to show more documentation than someone who is in a heterosexual relationship to prove the bona fides of your current relationship. But know that if there has been a switch between sexual orientations in your past, credibility of your current marriage is at risk. 2:06 In looking into a spouse’s past, CIS could also look at financial records and scrutinize the dates of divorce and remarriage. This becomes even more crucial in explaining what happened and documenting the validity of past relationships as well as current relationship and if there is any appearance of marriage fraud. [See more in video] 2:44 In the green card process, CIS will be concerned about gay couple’s credibility and may consider the prior relationship or the current one to be fraudulent and only entered into for purposes of getting a green card. [More in video. . . ] 3:27 Even for those who have not been married before, proving that the current relationship is real can be difficult, especially if the state where you reside bans gay marriage. Gay couples in the green card process may find it hard to hold the property in both names including bank accounts, health insurance, lease, tax returns if the state does not allow you to do so. With the Marriage (Same Sex Couples) Act 2013 coming into force and the first gay marriages taking place on the night of Saturday 29 March 2014, here is Marilyn Stowe's family lawyer's overview of the new legislation. For example, did you know that for same sex spouses, adultery cannot be given as the reason for divorce? Case law defines adultery as sexual intercourse between persons of the opposite sex. So a man can be divorced because of a sexual relationship with another woman, but cannot be divorced because of his sexual relationship with another man. Gay rights groups have pointed out that even if this persists, a gay spouse can still petition for divorce on the basis of their partner's unreasonable behaviour. Technically speaking, however, there is one scenario in which a same sex married couple could divorce because of "adultery". This would be if one spouse entered into a sexual relationship with a member of the opposite sex. In this interview, Marilyn looks at the legal iisues and remedies for same sex married couples across England and Wales.
